Scott Martinez Photography ("we," "us," or "our") is committed to protecting your privacy. This policy explains what information we collect, how we use it, and your rights regarding your data.
The short version: We do not sell, trade, or rent your personal information to anyone. Ever.
Information We Collect
We only collect information you voluntarily provide to us, which may include:
- Your name and email address when you contact us or request a free guide
- Phone number or other details submitted through our contact form
- Information about your photography session needs shared in messages
We do not use tracking cookies, analytics platforms, or any third-party data collection tools on this website.
How We Use Your Information
Information you provide is used only to:
- Respond to your inquiry or booking request
- Deliver requested resources (such as the Senior Session Style Guide)
- Send occasional updates about sessions, promotions, or availability — only if you opt in
We will never share, sell, or disclose your information to any third party for marketing purposes.
Promotional Use of Your Images
As part of our photography services, we may use images from your session for promotional purposes, including on our website, social media accounts (Instagram, Facebook), printed marketing materials, and portfolio presentations.
You have the right to request that your images not be used for any promotional or marketing purpose. To opt out, simply notify us in writing — by email or at the time of booking — and we will honor your request fully. Opting out has no effect on the services we provide to you.
For minors, we require written permission from a parent or legal guardian before using any session images for promotional purposes.
Email Communications
If you provide your email address, you may receive occasional messages from us. You can unsubscribe from any email at any time by replying with "unsubscribe" or using the unsubscribe link in the message. We will never send spam.
Third-Party Services
Your delivered images are hosted and shared through SmugMug and ProofPix. These services have their own privacy policies which govern how your images are stored and accessed. We use these platforms solely for the purpose of delivering your photos to you.
Data Security
We take reasonable steps to protect your personal information. However, no method of electronic transmission is 100% secure, and we cannot guarantee absolute security.
Children's Privacy
We photograph minors regularly as part of dance, sports, and portrait sessions. We do not knowingly collect personal data directly from anyone under the age of 13. All communications regarding minors are conducted with a parent or guardian.
Changes to This Policy
We may update this policy from time to time. The effective date at the top of this page will reflect the most recent revision. Continued use of our services after any changes constitutes acceptance of the updated policy.

Terms of Service
By booking a session with Scott Martinez Photography or using this website, you agree to the following terms. Please read them carefully.
Booking & Payment
- A non-refundable retainer is required to secure your session date. This retainer is applied toward your total session fee.
- The remaining balance is due on or before the day of your session.
- Session dates are not held without a signed agreement and retainer on file.
Rescheduling & Cancellations
- We understand that life happens. Sessions may be rescheduled once with at least 48 hours' notice at no additional charge.
- Cancellations with less than 48 hours' notice may forfeit the retainer.
- In the event of illness, emergency, or extreme weather, we will work with you to find a suitable alternative date.
Image Delivery
- Edited images are typically delivered within 2–3 weeks of your session via your private online gallery.
- Rush delivery may be available for an additional fee — ask us about availability.
- Raw/unedited files are not included and are not available for purchase.
Copyright & Usage Rights
Scott Martinez Photography retains full copyright of all images created during a session. Upon full payment, clients receive a personal use license which allows them to:
- Print images for personal use
- Share images on personal social media accounts with photographer credit
- Use images for personal purposes (graduation announcements, gifts, etc.)
Images may not be sold, used for commercial purposes, altered and redistributed, or submitted to publications or contests without prior written permission from Scott Martinez Photography.
Promotional Use
As noted in our Privacy Policy, we may use session images for promotional purposes. Clients may opt out of promotional use at any time by notifying us in writing. See the Privacy Policy tab for full details.
Client Responsibilities
- Clients are responsible for arriving on time and prepared for their session.
- For outdoor sessions, weather-related rescheduling is at the photographer's discretion.
- Scott Martinez Photography is not responsible for dissatisfaction resulting from failure to follow pre-session preparation guidance.
Limitation of Liability
In the unlikely event of equipment failure, file corruption, or other circumstances beyond our control, liability is limited to a refund of amounts paid. We carry professional liability insurance and take every reasonable precaution to protect your images.
Governing Law
These terms are governed by the laws of the State of Washington. Any disputes shall be resolved in Spokane County, Washington.
